Road Accidents with Unregistered Vehicles

 

If you are injured in an motor vehicle accident with a vehicle that is either unregistered or that you are unable to identify you are still  entitled to make a claim, subject to negligence in States or Territories where a fault based scheme is in operation. The claim will be made against a Government body called the Nominal Defendant who acts as the CTP insurer for the unregistered or untraceable vehicle.

If the injury is arising from a vehicle you are unable to identify you must take all necessary steps to try to identify the vehicle concerned. This includes reporting the accident to the Police and seeking witnesses to the accident by who may be able to assist, for example, placing an advertisement in a local newspaper and interviewing residents nearby to the accident scene.
